Terms of Use

1. What Anka does

Anka helps people follow through on personal goals, habits and challenges by creating a challenge, checking in, and involving trusted supporters.

Anka is designed to provide encouragement, accountability and social support. It is not a medical, mental health, fitness, financial, legal or professional advice service.

2. Who can use Anka

You must be at least 18 years old to use Anka.

By using Anka, you confirm that you are old enough to use it and that the information you provide is accurate.

3. Your account

You may need to create an account to use some parts of Anka.

You are responsible for keeping your login details safe and for all activity on your account. Please tell us as soon as possible if you think someone else has accessed your account.

We may suspend or close your account if we reasonably believe you have broken these terms or used Anka in a way that could harm other users, Anka, or ANAVPA LTD.

4. Your content

You are responsible for the goals, challenges, messages, check-ins, comments, images and other content you create or share through Anka.

You keep any rights you have in the content you submit to Anka. By creating or sharing content through Anka, you give us permission to host, store, display, process and use that content as needed to provide, operate, protect, improve and develop Anka.

This permission includes allowing us to show your content to the people you choose to involve in your challenge, such as your supporters.

You must not use Anka to create, share, encourage or promote anything that is:

• unlawful, harmful, abusive, threatening, harassing or discriminatory;
• sexually explicit or exploitative;
• bullying, shaming or intended to pressure someone in a harmful way;
• false, misleading or impersonating someone else;
• infringing someone else’s rights, including intellectual property rights;
• encouraging self-harm, eating disorders, dangerous behaviour, or other serious harm;
• spam, scams, malware, or other misuse of the service.

We may remove content or restrict access to Anka if we reasonably believe these rules have been broken.

5. Supporters and invitations

Anka may let you invite other people to support you.

You should only invite people you trust and who you believe would be comfortable receiving the invitation. You are responsible for the contacts you choose to invite and the information you share with them.

Supporters are responsible for their own messages and behaviour on Anka.

6. Health, wellbeing and safety

Anka may be used for goals relating to fitness, wellbeing, routines, habits or personal development. Anka does not assess whether a goal is safe, suitable or appropriate for you.

You are responsible for deciding whether a goal or challenge is right for you. You should seek professional advice before starting anything that could affect your physical or mental health.

If you feel at risk of harming yourself or someone else, or you are in immediate danger, contact emergency services or a crisis support service immediately.

7. Acceptable use

You agree not to:

• misuse Anka or try to interfere with how it works;
• access Anka using automated tools without permission;
• attempt to copy, reverse engineer, scrape or exploit Anka;
• use Anka to send spam or unwanted messages;
• use Anka to harass, manipulate, shame or pressure another person;
• use Anka for unlawful purposes.

8. Our rights in Anka

Anka, including its name, branding, design, software, text and other materials, belongs to ANAVPA LTD or our licensors.

You may use Anka for your own personal use. You must not copy, modify, sell, distribute, or build a competing service using Anka’s content, design or technology without our permission.

9. Product data and analytics

We may collect and use information about how Anka is used to operate, improve, protect and develop the service.

Where possible, we may use aggregated or anonymised information so that it does not identify you personally.

Our use of personal data is explained in our Privacy Policy.

10. Changes to Anka

Anka is an early-stage product and may change over time.

We may add, remove, suspend or change features. We will try to avoid disrupting your use of Anka unnecessarily, but we cannot guarantee that Anka will always be available or unchanged.

11. Paid features

Anka is currently free to use while in early testing.

If we introduce paid features, subscriptions or in-app purchases, we will provide the relevant pricing, renewal and cancellation information before you buy.

12. Ending your use of Anka

You can stop using Anka at any time.

You may be able to delete your account from within the app or by contacting us at anthony.a.paine@gmail.com.

We may suspend or close your account if you break these terms or if we need to protect users, Anka, or ANAVPA LTD.

13. Privacy

Your privacy matters to us.

Our Privacy Policy explains what personal data we collect, how we use it, who we share it with, how long we keep it, and what rights you have.

You should read our Privacy Policy before using Anka.

14. Our responsibility to you

We will use reasonable care and skill in providing Anka.

However, Anka is provided on an “as is” and “as available” basis. We do not guarantee that Anka will always be available, uninterrupted, secure or error-free.

We are not responsible for:

• goals or challenges you choose to set;
• actions you take based on Anka;
• content posted by users or supporters;
• loss caused by events outside our reasonable control;
• business losses, lost profits, lost revenue, or lost opportunities.

Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

15. Changes to these terms

We may update these terms from time to time.

If we make significant changes, we will take reasonable steps to let you know. The latest version will apply when you use Anka.

16. Governing law

These terms are governed by the laws of England and Wales.

If there is a dispute, the courts of England and Wales will have jurisdiction, except where consumer law gives you the right to bring a claim somewhere else.
